Fixed [Indev 0.51.1] Fake Out Fails upon Switch In

After switching in, when I use Fake Out, it fails. I've seen it recently on battle simulators, and I'm pretty sure that Fake out shouldn't fail after switching in.

What I expected to happen:
Fake out to succeed after switching in.

What actually happened:
"Fake out failed!"

Steps to reproduce:
Use Fake out after switching in.

You switch your pokemon and used Fake Out? Or you sent the pokemon after other one being defeat?
I switched into my Pokemon and used Fake Out, without the first one fainting.

EDIT: I tried both this time on P3D, the result was:
1- When switching to a Pokemon and the first pokemon hasn't fainted, Fake out fails. "Fake Out Failed!". I've tried this more than once.
2- When switching to a Pokemon and the first pokemon has fainted, Fake out works.

I'm using the latest version (v0.51.1).

It happens because Fake Out onky works the first turn the user is in battle. If you switch in that pokemon, that turn will count like its first turn in battle, but if you switch this pokemon and switch it again when the replacer be fainted (like your second result), Fake Out will work again.

But I checked and tried it now on a Battle Simulator, it's supposed to work after switching in. It shouldn't fail.

Fake Out works in Pokemon 3D like the original serie of Pokemon games. Your battle simulator have a difference.

Where is your source of how it does work in P3D, and how it should be working in the games?

(I just woke up, and I need to re-read everything again, tomorrow.)

I tested the move in the Pokemon version Black 2 and in Pokemon 3D and based in this page of the wiki http://pokemon3d.net/wiki/index.php?title=Pokémon_Move/Fake_Out , pokemondb http://pokemondb.net/move/fake-out and this gamefaqs http://www.gamefaqs.com/boards/696959-pokemon-x/65391748 .
You can reproduce these situations too:
1. Use Fake Out. It will work. Use again and it will fail, no matter how times you try, unless you do the situation 2.
2. Use Fake Out and switch your pokemon and let the next be fainted or switched by a move like Whirlwind. The move will work reseted and you will can use it again.
3. Regardless of whether you have used the move before, switch (manually or by a move like U-Turn) your pokemon in the battle by another one which know Fake Out. Use the move and it will fail.
